Terms of Service

Promtfolio ("Promtfolio", "we", "us") is a service operated by [legal name], [address], Israel, contact [support@promtfolio.com]. These Terms govern your access to and use of the Promtfolio website and the related application and services (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

Promtfolio reads a portfolio website you provide, generates a new website based on its content, hosts that site, and provides an AI assistant ("portfolio manager") that lets you edit and maintain the site through chat. The generated site may be published at a promtfolio.com address or, on the Pro plan, at a custom domain you connect.

You must be at least 18 and able to enter a binding contract. You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it current.

Plans. Basic is $8 per month (or $80 per year). Pro is $24 per month (or $240 per year). Annual plans are billed once per year.

Free trial. New paid subscriptions include a 7-day free trial. If you do not cancel before the trial ends, the plan converts to a paid subscription and the first charge is taken at that time. We send a reminder before the trial ends.

Payment processor / Merchant of Record. Payments are processed by Lemon Squeezy, which acts as the Merchant of Record and seller of record and collects and remits applicable taxes (such as VAT/GST).

Renewal and cancellation. Subscriptions renew automatically until cancelled. You may cancel at any time from your account or the processor's customer portal; cancellation takes effect at the end of the current billing period.

Refunds. [Refund policy to be finalized with counsel.] Price changes apply with at least 30 days' notice before your next renewal.

You provide the source. You give us a portfolio URL and direct us to import its text and media ("Your Content").

You confirm you have the rights. You represent and warrant that you own or have all necessary rights, licenses, and permissions to use, copy, host, and display Your Content through the Service, and that doing so does not infringe any third party's rights.

Stock and third-party media warning. Imported sites often contain stock photography, fonts, client work, or other third-party material licensed only for the original site and not for re-hosting. You are solely responsible for confirming you hold the rights to every imported asset before publishing.

Asset hosting. When you subscribe, the Service may download and optimize media so it is served from our storage. This is a technical hosting step; it does not transfer to you any rights you did not already hold in that media.

The generated site. The website Promtfolio generates from Your Content is yours to use. The underlying templates, software, and system remain ours.

You agree not to use the Service for unlawful, infringing, deceptive, or harmful content; to import sites or assets you do not have rights to; to break, overload, scrape, reverse-engineer, or circumvent limits or security of the Service; or to generate spam, malware, or content that violates others' rights. We may rate-limit, suspend, or terminate accounts that abuse the Service.

The Service, including its software, templates, design system, branding, and name and logo, is owned by us. These Terms grant you no rights in our intellectual property except the limited right to use the Service per these Terms.

The Service uses third-party AI models (currently provided by Anthropic) to analyze Your Content and generate text and layout. AI output can be inaccurate or unexpected; you are responsible for reviewing what is published on your site. We do not guarantee any particular result, ranking, or outcome.

If you connect a custom domain (Pro), you are responsible for owning that domain and its DNS configuration. The Service depends on third-party providers (including Supabase, Lemon Squeezy, Cloudflare, and Anthropic) whose availability is outside our control.

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or other users. On termination your published sites may be taken down; we may delete Your Content after a reasonable period.

The Service is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, or that imported assets are properly licensed.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

You agree to indemnify and hold us harmless from claims arising out of Your Content, your use of the Service, or your breach of these Terms, including third-party claims that an imported asset infringed their rights.

We may update these Terms. If changes are material, we will give reasonable notice. Continued use after changes take effect means you accept them.

These Terms are governed by the laws of the State of Israel, without affecting any mandatory consumer rights you have where you live.
